These Terms of Service & Conditions ("Terms") form a legally binding agreement between you ("Client") and Kelly Meerbott Coaching ("we," "us," or "our"). By engaging our coaching services or using our website, you agree to these Terms. If you don't agree, please do not proceed.

1. Services Overview

Kelly Meerbott Coaching offers:

- Individual executive coaching

- Organizational leadership coaching and consulting

- Group coaching cohorts

- Keynote speaking and facilitation

- Leadership assessments and custom programs

- Digital resources and educational materials

Daily Affirmation Messages

1. Daily affirmation SMS messages to help motivate and inspire you.

2. You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

3. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected].

4. Carriers are not liable for delayed or undelivered messages.

5. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

2. Pricing & Payment

Coaching packages and pricing vary by service and are confirmed in your engagement agreement.

Payment is due as specified in your agreement (typically upfront or in installments)

Payments are processed securely via Stripe

All fees are in USD unless otherwise stated

3. Client Responsibilities

You must be 18+ or have legal guardian consent

You agree to show up prepared and engaged for scheduled sessions

You're responsible for implementing insights and taking action on your goals

You agree to communicate openly and honestly in the coaching relationship

4. Scheduling & Cancellations

Sessions must be scheduled via our online booking system or as agreed

Cancellations must be made at least 24 hours in advance to avoid forfeiture of the session

Late cancellations or no-shows may result in loss of that session

Rescheduling is available based on coach availability

5. Confidentiality

All coaching conversations are confidential and follow ICF ethical guidelines

Exceptions include situations where there is imminent risk of harm to yourself or others, or where disclosure is legally required

We may use anonymized case studies or testimonials with your permission

6. Acceptable Use

You agree not to:

Share proprietary coaching materials without permission

Record sessions without explicit consent

Use coaching services for illegal, harmful, or unethical purposes

Misrepresent the coaching relationship or our services

7. Intellectual Property

All content, frameworks, materials, and resources provided by Kelly Meerbott Coaching are protected by copyright. You may not reproduce, distribute, or sell any materials without written permission.

8. Refunds & Cancellations

Coaching packages are non-refundable once purchased, except where required by law

Unused sessions may be forfeited if not used within the agreed timeframe

Organizational programs have separate cancellation terms outlined in service agreements

9. Coaching Relationship Boundaries

Coaching is not therapy, counseling, or medical advice

We may refer you to appropriate professionals if your needs fall outside coaching scope

The coaching relationship is a partnership, and results depend on your engagement and action

10. Liability Limitations

We are not liable for outcomes, business decisions, or actions taken as a result of coaching. Maximum liability = last payment received for services.

Coaching is a collaborative process. Your results depend on your effort, engagement, and follow-through.

11. Updates to Terms

Terms may be updated periodically. Continued use of services or our website means acceptance of any changes. We'll notify clients of significant changes.

12. Dispute Resolution

Any disputes will be resolved through good-faith negotiation first. If necessary, disputes will be handled in accordance with Pennsylvania law.
